Heard learned counsels for the parties.

The petitioner has assailed the order passed by the learned Sessions Judge, North 24 Parganas on 15th March, 2024 in C.M.C. Case no. 07 of 2024 cancelling the interim bail granted to the petitioner and the order passed by the learned Additional Chief Judicial Magistrate, Bidhannagar issuing warrant of arrest against him vide order passed on 5th July, 2024 pursuant to the order passed by the learned Sessions Judge.

It appears that the petitioner was granted interim bail by the learned Sessions Judge by order passed on 25th January, 2024 subject to certain conditions. The next date for appearance of the petitioner was fixed on 15th March, 2024. On the said date the petitioner failed to appear before the learned Court and was

not represented despite repeated calls. Learned Judge did not extend the interim bail further and in fact, cancelled the bail of the petitioner. Upon receipt of the said order, the learned Magistrate issued warrant of arrest against the petitioner. The petitioner undertakes to surrender before the learned Additional Chief Judicial Magistrate, Bidhannagar within seven days from date. If he surrenders before the learned Magistrate within the stipulated time frame and prays for bail, the learned Magistrate shall deal with the application for bail in accordance with law. The warrant of arrest issued vide order passed on 5th July, 2024 be stayed till 4th October, 2024. In the event the petitioner fails to appear before the learned Magistrate within the said time frame, learned Magistrate shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court. The revisional applications being CRR 3629 of 2024 and CRR 3630 of 2024 are disposed of.
