The grievance of the petitioner is directed against the illegal filling of a water body situated at the subject premises at Mouza Chowbhaga, J.L. No.3, P.S. Tiljala. It is submitted on behalf of the petitioner that notwithstanding the fact that having filed repeated representations to the respondent authorities no steps have been taken by the respondent.
Mr. De, appears on behalf of the State respondents and submits upon instructions that the allegations made by the petitioner are all of a very serious nature and require investigation.
In view of the submissions made on behalf of the parties, the respondent No.2 is directed to consider and dispose of the representation dated 19th September, 2020
filed by the petitioner within a period of three months from date and after giving a right of hearing to all the affected parties.
The respondent No.2 is also directed to communicate his decision on the Advocate appearing on behalf of the petitioner within a period of two weeks from taking the same.
I make it clear that I have not gone into the merits of the case and all points are left open to be decided by the respondent No.2. In disposing of the aforesaid proceeding, the respondent No.2 will not be influenced by any observation made in this order.
It is submitted on behalf of the petitioner No.2 that the petitioner has expired during the pendency of this writ petition. This would not prevent the respondent No.2 from considering the aforesaid representation. With the aforesaid directions, WPA 19217 of 2019 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
