Banerjee) Mr. Tarak Nath Halder ... for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division) 2nd Bench at Barrackpore to dispose of the application under Section 7(3) of the West Bengal Premises Tenancy Act, 1997 filed in Ejectment Suit No. 100 of 2009 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this application this court finds that the application under Section 7(3) of the 1997 Act was taken up for hearing

on May 15, 2025 and the plaintiff was heard in full and June 30, 2025 has been fixed for hearing the submissions of the defendant. It further appears from the order-sheet that September 24, 2025 has been fixed for hearing of the application under Section 7(3) of the 1997 Act.

In view thereof, CO 3283 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division) 2nd Court at Barrackpore to make an endeavour to dispose of the application under Section 7(3) of the 1997 Act filed in Ejectment Suit No. 100 of 2009 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, preferably within a period of six working weeks from the next date fixed.
