Petitioner(s) Mr. Soumya Nag Mr. Rajdeep Sengupta ... for the petitioner(s) The petitioner has approached this court for cancelling the order dated 17.07.2017 thereby granting bail to the o.p. no.2. Learned advocate for the petitioner submits that earlier a case under Section 498A of the IPC was registered and when the said proceeding was pending, again, an unfortunate incident happened, consequent to which Maheshtala Ps Case No. 376 of 2017 u/s 498A/304B/306 of the IPC along with Section 3/4 of the DP Act was registered for investigation.

The records of the case also reflect that the bail was granted more than eight and half years ago. The present stage of the proceedings presumably is at the advanced stage and/or towards the end and/or has been completed.

Since substantial time has lapsed in the meantime, at this stage, it would not be wise to interference with the liberty granted to the o.p. no.2.

However, if there are circumstances for which the learned jurisdictional court (if it is still in seisin of the case) feels that

impediment is created by the o.p. no.2 in the progress of the trial, it would be the discretion of the said jurisdictional court to either impose conditions and/or cancel the bail on a proper application being filed and affording an audience to the o.p.no.2. With the aforesaid observations, CRM 8352 of 2017 is disposed of.
