The learned Counsel appearing for the petitioner submits that the petitioner is a retired employee of North Bengal State Transport Corporation and retired under voluntary retirement scheme. The petitioner has made a representation before the Managing Director, North Bengal State Transport Corporation, being the respondent no. 2 in the instant writ petition, but such representation has not been considered by the respondent no. 2 till date. Mr. Sen, learned Counsel appearing for the N.B.S.T.C., on instruction, submits that the benefits as narrated in the representation should be considered by the respondent no 2, in view of the circulars of the State Authorities.

The learned advocate-on-record of the petitioner is requested to serve a copy of this writ petition along with a copy of this order to the Managing Director, North Bengal State Transport Corporation, being the respondent no. 2 in the instant application within fifteen days from today.

As the representation has not been considered till date, I request the respondent no. 2 to consider the representation of the petitioner after giving an opportunity of hearing to the petitioner to allow the petitioner to produce necessary documents at the time of hearing and

pass a reasoned order within a period of sixteen weeks from today. The reasoned order should be communicated to the petitioner at an earliest. I make it clear that I have not gone into the merits of the writ petition, all the issues are left open to the Managing Director, being the respondent no. 2 to be decided by him.

Since no affidavits have been invited, the allegations contained to the writ petition are deemed not to have been admitted by the respondents.

The writ petition is disposed of.

There will be no order as to costs.
