Banerjee) Mr. Debanik Banerjee Ms. Huzaifa Shahid ...for the petitioner Ms. Shohini Chakrabarty Ms. Prajaini Das ...for the opposite parties This application under Article 227 of the Constitution of India is at the instance of the defendant and is directed against order dated July 29, 2025 passed by the learned Civil Judge (Sr. Division) 4th Court at Alipore in Ejectment Suit No. 55 of 2022. By the order impugned, the date for hearing of the defendant/petitioner herein on the application for amendment of plaint filed by the plaintiffs/opposite parties, was fixed. After going through the order impugned it appears to this court that the plaintiffs/opposite parties were only heard on the application for amendment and the defendant/petitioner is only to make his submissions on the amendment

application. By the order impugned no rights of the parties have been decided.

For such reason this court is not inclined to interfere with the order impugned.

Chakrabarty, learned advocate appearing for the opposite parties submits that September 23, 2025 is the next date fixed for hearing of the defendant on the amendment application.

With the above observation CO 3287 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Division) 4th Court at Alipore to dispose of the amendment application expeditiously without granting any unnecessary adjournment to either of the parties.

It will be open to the parties to make their appropriate submissions before the learned trial judge at the time of hearing of the amendment application.
