The petitioner prays for reconnection of supply. The supply was disconnected on the ground of theft of electricity. The petitioner has preferred an appeal from the final assessment, upon deposit of 50% of the amount. The reconnection can only be allowed if the petitioner deposits the entire amount assessed, without prejudice to his rights in the appeal.

Under such circumstances, the remaining 50% shall be paid in five equal monthly instalments. Upon deposit of the second instalment and reconnection charges, supply will be restored. Failure on the part of the petitioner to deposit the other instalments and the current electricity charges which shall be raised upon such restoration, will entitle the authorities to disconnect once again. The payment and acceptance will be without prejudice to the rights of the parties in the appeal.

The West Bengal State Electricity Distribution Company Limited shall issue a letter to the petitioner within

a week with regard to the breakup of the remaining amount, indicating the date and the amount to be paid in instalments. Accordingly, the writ petition is disposed of. Parties are directed to act on the basis of the server copy of this order.
