The petitioners allege that the Pradhan, Dhapdhapi Gram Panchayat-I, being the 3rd respondent herein, along with his men and associates have illegally and forcibly installed a lamppost in the middle of the petitioners' land without consent of the petitioners. The petitioners seek to submit a representation before the concerned Executive Officer, Baruipur Panchayat Samiti, being the 2nd respondent herein, ventilating their grievance. On prayer of the petitioners, liberty is granted to submit a comprehensive representation before the 2nd respondent within seven days from date. The 2nd respondent shall consider and dispose of the representation within four weeks from date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof.

In the event the lamppost installed on the plot in question is found to be illegal/unauthorised or without consent of the petitioners who claim to be owners of the land, the concerned authority shall take necessary steps in accordance with law.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
