1. Petitioner contends learned Magistrate allowed maintenance allowance at the rate of Rs.10,000/- per month from the date of application. Order was assailed by the petitioner in Criminal Motion No.13 of 2023. By order dated 08.04.2024 the revision petition was dismissed and the maintenance order was upheld. However, in the revision petition preferred by opposite party no.1, order of maintenance was modified and directed to operate from the date of the order.

2. Let a copy of the petition be served upon opposite party no.1 through Registered Speed Post with Acknowledgment Due and opposite party no.2-State through the learned Public Prosecutor, High Court, Calcutta and file affidavit-of-service on the next date of hearing.

3. Let the matter appear as 'Contested Application' four weeks after ensuing Puja Vacation.

4. There shall be stay of the order dated 08.04.2024 passed by the learned Additional Sessions Judge, Tehatta, Nadia in Criminal Revision No.06 of 2023 for a period of six weeks after ensuing Puja Vacation or until further orders, whichever is earlier.

5. Liberty is given to the parties to apply for extension and/or modification and/or variation of this order upon notice to the other side.

6. Photostat certified copy of this order, if applied for, be given to the petitioner on usual undertaking.
