The writ petitioner was working as Programme Officer under the West Bengal State Health and Family welfare Samity at Malda. In addition to that he was also additional charge as the District Programme Officer. He was allowed to additional remuneration for the additional charge and work given to him until 2020.

The State by a notification dated 9th October, 2020 had discontinued any additional payment for additional charge given to programme officers under the health department. The concerned departments were directed to fill up the vacant posts by recruitment.

The petitioner claims that no recruitment has been done since 2020 and he has the additional charge of the District Programme Officer till date. 4.

In view of the notification dated 9th October, 2020 (supra) the petitioner is not entitled to claim any additional remuneration for the temporary assignments given to him. However, State shall bear in mind that additional work normally involves additional payment.

Let a suitable decision be taken by the State in this regard. It shall be open to the petitioner not to accept any additional assignments outside the scope of his original work, for which he does not receive any remuneration.

The writ petition is disposed of.

There will be no order as to costs.
