None appears for the State respondents despite service of notice.
Mr. Soumitra Bandyopadhyay who usually appears for the State and is present in Court is requested to appear for the State respondents in this matter. His appointment be regularised by the learned Legal Remembrancer.
The grievance of the petitioner is that his land has been acquired for industrial purpose and handed over to the Hindustan Fertilizer Corporation Limited for construction of factory. No compensation was granted to him for the purpose. The land has not been utilised till date. The petitioner submitted a
representation before the authorities on 10th June, 2019 proposing to purchase the land by payment of present market value. The said representation is yet to be disposed of. The petitioner prays for a direction upon the 5th respondent to consider and dispose of the representation at the earliest.
Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the 5th respondent to consider and dispose of the representation filed by the petitioner dated 10th June, 2019 within a period of two months from the date of communication of this order after affording reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.
WPA 19351 of 2019 is disposed of. However, there shall be no order as to costs.
Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
