1. Heard learned Counsel for the parties.

2. It is fairly submitted by learned Counsel for the State that in the charge-sheet filed by the I.O., the name of the present petitioner does not find place.

3. The charge-sheet has been filed, however, in the name of one Sk. Salim Ali, son of Akbar Ali but the present petitioner is the son of one Earsad Ali though both the persons are of village Kalyanpur.

4. Learned Counsel for the State further submits that in view of confusion, he had a talk with the I.O. and the I.O. has clearly clarified that the present petitioner is not the charge-sheet named accused.

5. In view of such fact, the present petition for anticipatory bail being CRM (A) 3813 of 2023 is disposed of as infructuous. (Chitta Ranjan Dash, J.) (Partha Sarathi Sen, J.)
