Learned advocate appearing for the petitioner submits that similarly placed accused persons are already on bail pursuant to the earlier order dated 28th September, 2022 all the accused persons appeared before the learned A. C. J. M., Lalbag, Murshidabad. Mr. Dutta, learned Additional Public Prosecutor appearing for the State submits that copies under Section 207 of the Code of Criminal Procedure have already been supplied and the next date has been fixed on 12th October, 2022.
Having regard to the development of the case, I direct the learned Additional Chief Judicial Magistrate, Lalbag, Murshidabad to commit the case on the next date. In case any of the accused persons are absent, the learned Magistrate would issue harsher process of law. So far as the present petitioner is concerned, the prayer for bail is allowed.
Accordingly, the petitioner is directed to furnish bond of Rs.10,000/- with two sureties of like amount each, one of whom must
be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad on the following conditions:- i) If on bail, the petitioner shall meet with the Investigating Officer of the case once a week until further orders. ii) The petitioner shall not leave the jurisdiction of Ranitala P. S., without informing the learned Additional Chief Judicial Magistrate, Lalbag, Murshidabad or the learned trial court where the case is committed in future. iii) The petitioner shall not tamper with the evidence or threaten the witnesses of the case. If there is any violation of the condition, the learned trial court or the learned A.C.J.M, Lalbag would be empowered to cancel the bail without further reference to this court. With the aforesaid observations, the application for bail, being CRM (SB) 222 of 2022 is disposed of.
