The petitioner was aggrieved by the fact that in spite of Raiganj P.S.

Case No. 581 of 2019 being registered for investigation pursuant to the direction passed under Section 156(3) of the Cr.P.C by the learned CJM, Raiganj, no steps were taken so far as the progress of the investigation is concerned.

State has submitted a report which reflects that on conclusion of the investigation, charge-sheet has been

submitted on or about 2nd September, 2023 under Sections 406/420 of the IPC.

Since a public servant is involved which relates to misconduct of the said public servant, steps have been taken under the relevant provisions of law for assessing the acts of the said public servant in discharge of official duties.

The petitioner, accordingly, would take steps before the learned Trial Court, if till date, no sanction has been granted by the department for prosecution.

With the aforesaid observations, WPA 20906 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.

Report submitted by the State be kept with the record. A copy of the report be handed over to the petitioner.
