Tapan Gayen v. State Of West Bengal & ORS
WPA 22193 OF 2017 No. CAN 5519 of 2019) RP 25.11.2022 Ct.No. 25 TAPAN GAYEN vs.
STATE OF WEST BENGAL & ORS.
Mr. Subhas Chandra Atha Ms. Payel Paramanik ... for the petitioner Mr. Biswabrata Basu Mullick Mr. Arun Kumar Saha ... for State Mr. Gourav Das ... for DPSC Mr. Ratul Biswas Mr. Kaushik Chaudhury ... for Board This writ petition was filed praying for giving appointment to the petitioner in the post of Assistant Primary Teacher. When this matter was taken up for hearing on 15.09.2022 it was submitted by the learned advocate representing the District Primary School Council that the said Council shall send a proposal for appointment of the petitioner in an existing vacancy. The learned advocate for the State submitted that upon such proposal being sent the Commissioner of School Education shall recommend the name of the petitioner for appointment to the said post. Though the respondents woke up at the belated stage only after passing the order dated 17th November, 2022 but the fact remains that the appointment letter has been issued in favour of the petitioner and Mr. Das, learned counsel representing the Council submits that
the petitioner has already joined the post as an Assistant Primary Teacher in Bade Maheshpur FP. A copy of the memo no.APT-06/352-L/DPSC-24Pgs dated 18.11.2022 filed by the learned advocate for the DPSC, South 24 Parganas is taken on record.
Thus, the grievance of the petitioner has been redressed with issuance of the appointment letter in favour of the petitioner.
The writ petition, accordingly, stands disposed of without, however, any order as to costs.
Urgent Photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties, upon compliance of all formalities.
