1. The present petition has been filed challenging the order dated 12th August, 2022 passed by the District Consumer Disputes Redressal Commission, Sealdah Court, 1, Beliaghata Road, Kolkata -14.
2. At the outset this Court is of the opinion that this order should have been challenged before the State Consumer Forum. It is a settled proposition that if there is an alternative Forum and equally efficacious remedy is available then the Writ Court should be slow in entertaining the same. Upon this, learned counsel seeks permission to withdraw the petition with liberty to file it before the State Consumer Forum.
3. Liberty granted.
4. The State Consumer Forum may consider condoning the delay caused on account of filing of this petition before this Court. It is also made clear that this Court has not gone into the merits of the case and no expression made therein shall tantamount to be an expression on the merits of the case.
5. C.O. 2885 of 2022 stands disposed of.
6. Consequently, all pending connected applications, if any, also stands disposed of.
7. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
