Having regard to the contentions advanced by the petitioner, I am of the view that the same relate to question of facts and are to be agitated in course of trial or at the final stage of argument of the case.

Accordingly, CRR 2763 of 2012 is dismissed.

All pending connected applications, if any, are consequently disposed of.
