....For the Petitioner Affidavit-of-service, filed in Court today, is taken on record.

Mr. Saibal Acharyya, learned counsel appears for the petitioner.

None appears for the respondents.

Mr. Acharyya, learned counsel drawing attention to a communication dated May 8, 2017, Annexure-P10 at page 41 to the writ petition submits that, the petitioner had attended the hearing held on May 24, 2017 but till date no decision has been communicated to the petitioner as to the fate of his claim on account of higher pay scale. Considering the above submission and considering the materials on record and also considering the fact that, despite notice the State is not represented, no fruitful purpose shall be served by keeping this writ petition pending any further which is pending since 2018.

In view of the above, the respondent no.3 is directed to communicate its reasoned order to the petitioner positively within a period of three weeks from the date of communication of this order.

If the reasoned order goes in favour of the petitioner then, the respondent no.3 and/or all other authority/authorities shall immediately give effect thereto positively within a further period of three weeks from the date of the said reasoned order to be communicated to the appropriate authority.

Since affidavits are not called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.

With the above directions this writ petition, WPA 20278 of 2018 stands disposed of without any order as to costs.
