The revisional application was preferred challenging the proceedings pending before the Court of the learned Judicial Magistrate, 1st Court at Malda being complaint case no.1114C/2008 under Sections 498(A)/ 109/ 323 and 34 of the Indian Penal Code.

Having regard to the contentions advanced in the revisional application it is found that the same relate to question of facts and are to be canvassed at the stage of trial. This Court is not empowered to adjudicate on the issue raised by the petitioners. No interference is called for at this stage.

Accordingly, CRR 2764 of 2012 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, stands vacated.
