A copy of the report submitted by the Deputy Commissioner of Police, South Division, Kolkata be kept with the record. The said report is enclosed with documents forwarded by the Office of the Director General of Police, Odisha. The report reflects that the accused persons are unavailable at the said address and no whereabouts could be furnished by the villagers. Accordingly, the report is a ground for invoking the provisions of Section 82 of the Code of Criminal Procedure. The learned trial court is directed to take steps for invoking the provisions of Section 82 Cr.PC and the subsequent harsher process of law so far as the accused person is concerned. A copy of the report may be handed over to Mr. Dutta, learned advocate for the complainant/petitioner.

The complainant/petitioner would place the report before the learned Metropolitan Magistrate, 7th court, Calcutta who accordingly would take steps as directed above.

With the aforesaid observations, the revisional application being CRR 3270 of 2023 is disposed of.
