Prosecution case is that 20.800 kgs of ganja were recovered from the possession of the present petitioner. 2.

Learned counsel appearing on behalf of the petitioner submits that the prosecution has also included weight of 16 plastic packets and the cellophane tapes and if those weights of 16 packets are not taken into consideration, then the weight of the contraband substance will be of intermediate quantity. He further submits that he is in custody since 31st January, 2025 and the investigation has already been ended in charge-sheet. His further contention is two other accused persons in the instant proceeding are on court bail. Accordingly, the petitioner may be granted bail on any terms and conditions.

Mr. Sur, learned counsel appearing on behalf of the State opposed to the bail prayer contending that the commercial quantity of narcotic substance was recovered from the possession of the petitioner and the petitioner is not on the same footing with the other two accused persons who have been granted bail since they were arrested on the basis of co-accused statement. He further submits that even if the weight of the 16 plastic packets are deducted from the gross weight then also the weight of the narcotic substance can never be below the commercial quantity.

Having heard learned counsel for the petitioner and the State and that from the materials placed before me it appears that the rigour of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner, the prayer for bail made by the petitioner is rejected.

Accordingly, CRM (NDPS) 1106 of 2025 is disposed of. 6.
