Petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly, learned Advocate, who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned authorities in due course Learned advocate for the petitioner submits that the petitioner is no way connected as a family member of the in law's family of private opposite party at whose instance the present case being Indus P. S. Case No. 120/2022 dated 17-10-2022 under Sections 498A/323/307 of the Indian Penal Code has been initiated.

I have assessed the materials, which are primarily appearing in the FIR and the chargesheet wherein there are allegations of an illicit relationship between the present petitioner and the husband of the opposite party. However, the documents under Section 207 of the Code of Criminal Procedure are yet to be received by the petitioner. As such, I am not inclined to interfere at

this stage when the case is not matured for consideration. Accordingly the petitioner is directed to raise all the points before the jurisdictional court, if so advised, by taking out an application under Section 227 of the Code of Criminal Procedure at the time of consideration of charges.

Needless to state that if such an application is taken out, the learned court would consider the same in accordance with law without being influenced by any observations passed by this court. With the aforesaid observations, the revisional application being CRR 3268 of 2023 is disposed of.
