PP Mr. Arijit Ganguly Ms. Debjani Sahu ...for the State Affidavit of service filed by the petitioner is taken on record. The petitioner herein is aggrieved partially by the order dated 5th August, 2024 by which, the Trial court has granted him interim bail of Rs. 1,000/- with a condition that the accused person shall not enter into the house of the complainant until further orders. Petitioner's contention is that he is also the owner of the house and as such, such condition cannot be imposed with the bail order.

Having heard learned counsel for both the parties, the instant application being CRR 3653 of 2024 is hereby disposed by giving liberty to the petitioner to make a prayer before the court below for modification of the condition imposed in the bail order and in the event of making such prayer by the petitioner, the court below will dispose of such application in accordance with law without being influenced by any observations made herein, preferably within a period of three weeks from making such prayer.
