Adv., Mr. Banibrata Datta ...for the State The petitioner is aggrieved that no steps have been taken by the Durgapur Police Station in respect of complaint as regards the vandalism of his premises which is under tenancy from the private respondent.

Counsel for the police submits that they have taken out proceedings under Section 107 of the Cr. P.C. There is civil suit filed by the petitioner against the private respondent.

The petitioner's remedy is to seek appropriate measures before the Civil Court as may be permitted in law.

The Durgapur Police Station shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
