Affidavit of service filed by the petitioner is taken on record.

Learned advocate appearing for the petitioner submits that the petitioner has been employed as Assistant Teacher of History in Begunia High School (H.S.) which is 187 kms. Away from his residence and he has been serving in the said school for the last 18 years. To that effect, the petitioner submitted a transfer application with the District Inspector of Schools (S.E.), Paschim Bardhaman which was dated 31.07.2022 and was received by the said office on the same date. 3.

The petitioner's application for transfer on the ground of distance is pending before the District Inspector of Schools (S.E.), Paschim Bardhaman

for consideration. The petitioner seeks an order for expeditious disposal by the same by the D.I.

The respondents are represented.

Let this writ petition be disposed of with the direction upon the respondent No. 4/District Inspector of Schools (S.E.), Paschim Bardhaman to consider the petitioner's application is pending before it.

Let the said authority take a decision about the application filed by the petitioner and in case it allows the same should thereafter forward the same to the respondent/School Service Commission for consideration.

Let the said respondent/D.I. conclude the exercise within a period of four weeks from the date of receipt of copy of this order.

Needless to mention that in the event the District Inspector of Schools(S.E.), Paschim Bardhaman decides in favour of the petitioner, he shall immediately forward the records including his decision to the Chairman, School Service Commission shall take a decision on such issue as expeditiously as possible but positively within a period of four weeks from the date of receipt of the papers from the concerned D.I. of the school is aggrieved that his application for transfer, in terms

of the General Rules of transfer, though has been recommended and forwarded to the end of the respondent West Bengal Central School Service Commission the same is yet to be considered by the said respondent after granting an opportunity of hearing to the petitioner. Let its decision be communicated to the petitioner.

The writ petition as above, is disposed of.

10. Since no affidavit is called for in this case, the allegations made in the writ petition, are deemed to have been denied by the respondents.

11. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
