Mr. Sandip Chakraborty Mr. Aniket Mitra Mr. Swarvanu Saha ...for the petitioner Mr. Rudradipta Nandy Mr. Sujan Chatterjee ..for the State Learned senior counsel appearing on behalf of the petitioner submits as follows. The petitioner is only a name lender for the ownership of the premises in question, while the real person in control is one Hira Sheikh, who is a powerful man in the locality being a police officer. The petitioner has been falsely implicated in this case.
Learned counsel appearing on behalf of the State relies on the case diary, the report and strongly opposes the prayer for anticipatory bail. According to the statements of the 16 years old survivor, she was taken to the premises and asked to commit immoral acts. However, she refused medical examination. From the statements of witnesses, it appears that the ownership of the premises vests with the petitioner and another co-accused who is presently in custody. They had given the premises to be run by a caretaker who used to
take the name of the said Hira Sheikh so that others would not disturb their possession.
Considering the incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
