1. Heard the learned counsels for the parties.
2. Perused the case diary.
3. It appears from the injury report that the victim suffered serious injury on the scalp. Dressing was done and ten stitches were given. It appears that in the injury report only the names of the petitioner nos. 2 and 3 were specifically mentioned, amongst the present petitioners, along with others.
4. Considering the nature of allegations and the materials available in the case diary, the roles allegedly ascribed to the present petitioners, while I am not inclined to grant anticipatory bail to the petitioner no. 3, considering the fact that the petitioner no. 2 (Sakuntala Chakraborti) is an aged lady, her application for anticipatory is allowed
along with that of the petitioner nos. 1 (Soma Sharma) and petitioner no.4 (Rahul Sharma). The application for anticipatory bail of petitioner no. 3 is, accordingly, rejected.
5. In the event of arrest, the petitioner nos. 1, 2 and 4 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioner no. 4 shall meet the Investigating Officer once a fortnight till submission of report in final form.
6. Accordingly, the application for anticipatory bail is allowed-in-part.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
