Petitioner is aggrieved by the fact that he purchased a property. Immediately after purchasing the said property, the private respondent no. 5 had been creating obstruction to that effect the respondent no.

had been erecting illegal construction over the government property in order to ensure that the free egress and ingress of the petitioner is blocked.

Grievance of the petitioner is that the police authorities in spite of being informed of such incidents have not taken any steps.

State has submitted a report. Report reflects that a land dispute is existing over the issue

of creating a temporary shed by pillar and asbestos shed in front of the land of the petitioner beside Dhola to Ramganga PWD road. To that effect, police authorities have already drawn up proceedings under section 126 of the BNSS and enquiry is still in progress according to the Inspector-in-Charge, Dholahat Police Station.

Consequently, I direct that over the issue of egress and ingress of the petitioner to his own property, there should not be any breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the petitioner and the respondent no. 5.

With the aforesaid observations WPA 21224 of 2025 is disposed of.
