The instant writ petition has been filed, inter alia, complaining illegal construction by the respondent no. 7 at holding no. 62, Sree Arabinda Raod (Santragachi), LP-3/8/1, Howrah, Pin - 711104, West Bengal.

Having heard the learned advocates appearing for the respective parties and noting that a compliant had already been made by the petitioner's way back in the year 2024 alleging illegal construction and noting from the submission made by Mr. Banerjee, learned advocate appearing for the Howrah Municipal Corporation that the Municipal authorities are yet to favour him with instruction in this matter, I am of the view that the municipal authorities must enquire into the petitioner's representation by carrying out an inspection at the locale upon prior notice to the interested parties.

The petitioner's representation must be disposed of by passing a reasoned order upon hearing the interested parties and if from the basis thereof, any illegal construction is noted, appropriate steps shall be taken to not only arrest future illegal construction but to initiate and bring the proceedings to a logical conclusion as expeditiously as possible preferably within a period of 8 weeks from the date of initiation of such proceeding. 5.

It is made clear that this Court has not gone into the merits of the case and the municipal authorities shall decide the same without being influenced by any of the observations made hereinabove.

With the above observation and direction, the writ petition is disposed of.
