WPA No. 21622 of 2024 Netai Mandal Vs.

The State of West Bengal and others Mr. Nirmalendu Bera, Mr. Gora Chand Samanta ... for the petitioner.

Mr. Swapan Kumar Banerjee, Mr. Diptendu Narayan Banerjee ...for the State.

Mr. Suprabhat Bhattacharya, Mr. Biswajit Das ...for the private respondents.

Affidavit-of-service filed by the petitioner is taken on record.

The petitioner alleges that the police authorities are not taking any steps for implementation of the order of status quo passed by the learned Civil Court. Mr. Bhattacharya, learned Advocate appearing for the private respondents submits that the dispute is purely civil in nature. He further submits that two other writ petitions filed by the petitioner alleging police inaction are also pending before this Court.

A report of the Inspector-in-Charge, Raidighi Police Station dated September 3, 2024 is already in the record.

After going through the said report, this Court finds that pursuant to the complaint filed by the

petitioner, an FIR has been registered, being Raidighi Police Station Case No. 382 of 2024 dated July 6, 2024 under Sections 447/323/354/307/427/506/34 of the Indian Penal Code and after completion of investigation, the concerned Investigating Officer submitted chargesheet vide Raidighi Police Station Charge Sheet No. 395 of 2024 dated July 31, 2024 under Sections 447/323/506/34 of the Indian Penal Code. It appears that the police authorities have been taken steps pursuant to the complaint lodged by the petitioner. Since an order of status quo has been passed by the learned Civil Court and it has been stated before this Court that the said order of status quo was extended and the same is in force, this Court directs the Inspector-in-Charge, Raidighi Police Station to implement the said order of status quo. The Inspectorin-Charge, Raidighi Police Station is further directed to see that no breach of peace takes place at the locale. With the above observations and directions, the writ petition stands disposed of.

There will be no order as to costs.

Photostat certified copy, if applied for, be given to the parties.
