Affidavit-of-service is taken on record. Despite service, none appears on behalf of the respondents. The petitioner challenges the engagement of the respondent No.6, Susmita Mandal, as an Accredited Social Health Activist (in short ASHA) in a health centre at Haludbari under Khejuri-II Development Block. The allegations are that the petitioner was better qualified and had obtained higher marks than the candidate, who had been engaged. That the merit list was not published and the seniority of the candidates had not been maintained. It does not appear to the Court that the submissions of the petitioner are backed by supporting documents. Under such circumstances, this Court is not in a position to pass necessary orders, as prayed for. If the petitioner approaches the Sub-Divisional Officer, Contai, District-Purba Medinipur with better particulars in respect

of the aforementioned selection, the Sub-Divisional Officer, Contai, shall dispose of the same in accordance with law upon hearing the petitioner, the respondent No.6 and any other interested party. A reasoned order shall be passed and communicated to the petitioner.

The entire exercise shall be completed within a period of three months from the date of receipt of the petitioner's representation.

This Court has not gone into the merits of the allegations made by the petitioner. All issues shall be decided by the authority, independently.

The petitioner is directed to serve a copy of the writ petition along with a server copy of this order upon the Sub-Divisional Officer, Contai, Purba Medinipur. The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
