Learned advocate appearing for the petitioner submits that petitioner is an employee of a medical shop/business wherein the Director has been granted anticipatory bail by the Co-ordinate Bench. The Co-ordinate bench at the time of granting anticipatory bail recorded that the original documents relating to the seized articles were produced before the Investigating Officer of the case.

Having considered that the petitioner is an employee who is in custody for more than 5 months and the Director of the said company has been granted anticipatory bail, I am of the view that the same privilege must be granted to the petitioner.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Saddam Hossain shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Judge Special Court under NDPS Act cum Additional Sessions Judge, 5th Court at Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the District of Murshidabad without prior permission of the learned Special Court.

Since the investigation of the case is still continuing, petitioner shall make himself available as and when called for by the Investigating Officer.

Report submitted by the State be kept with the record. Accordingly, CRM (NDPS) 1111 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
