01.09.2023 sdas rejected C.R.M.(DB) No. 3394 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat Police Station Case No. 287 of 2023 dated 12.05.2023 under Sections 448/307/379/427/34 of the Indian Penal Code and adding Section 302 of the Indian Penal Code.
And In Re : Prasenjit Shil & Anr. .... Petitioners Mr. Sumanta Das ....for the petitioners Mr. Madhusudan Sur, learned APP Mr. Dipankar Paramanick ...... for the State 1.
Learned Counsel for the petitioners submits they are in custody for 110 days. It is also submitted that they have been falsely implicated at the behest of the de facto complainant. They pray for bail.
2. Learned Counsel for the State opposes the bail prayer. He contends bail prayer of co-accused similarly circumstanced with the petitioners, has been rejected.
3. We have considered the materials on record. Petitioners were present with co-accused at the time when the victim was assaulted. In view of the aforesaid incriminating materials on record and nature of offence, we are not inclined to grant bail to the petitioners.
