1. The review application as of date has become infructuous since the application under Section 9 of the Arbitration and Conciliation Act directed to be heard and disposed of on merits in terms of the order passed by the Coordinate Bench on 6th August, 2024, was dismissed for default.

2. The learned Counsel for the review applicant submits that having regard to the existence of an arbitration agreement, the arbitration proceeding may commence immediately so that the applicant may have its grievance redressed by filing an application for interim measure and any other relief to which the applicant is permitted to in law. However, it appears from the arbitration agreement that an authority has been named and designated in this regard and the rules of procedure would be of that authority for which we are not inclined to appoint an arbitrator on the basis of the request made on behalf of the applicant. It would be open for the applicant to approach the said authority for appointment of

an arbitrator in accordance with the rules prescribed by Delhi International Arbitration Centre, the designated authority, therein.

3. In view of the above, the review application is accordingly, disposed of with the above observation. However, there shall be no order as to costs.
