Mr. Siva Prosad Ghosh ...for the preamptor This application under Article of the Constitution of India is at the instance of the preemptor praying for a direction upon the learned Civil Judge at Barrackpore to dispose of the Misc. Case No. 12 of 2024 as expeditiously as possible.
On the prayer of Mr. Ghosh, learned counsel for the petitioner leave is granted to the learned advocate to amend the cause title of the civil revisional application here and now.
Mr. Siva Prosad Ghosh, learned counsel for the petitioner submits that the petitioner filed an application under Section 8 of the West Bengal Land Reforms Act which is registered as Misc. Preemption Case No. 12 of 2024. He further submits that the opposite party herein filed an application under Order VII Rule 11 of the Code of Civil Procedure and the hearing of the said application is being adjourned from time to time. He further submits that the said application is otherwise ready for hearing and August 20, 2025 has been fixed for hearing of such application.
In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any
notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial Court.
In the light of the submission made by the learned advocate for the petitioner this civil revision application being C.O.No. 3066 of 2024 stands disposed of by requesting the learned Civil Judge, Junior Division, 2nd Court at Barrackpore to take up the hearing of the application under Order VII Rule 11 of the Code of Civil Procedure on the next date fixed i.e. on August 30, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Depending on the fate of the application under Order VII Rule 11 of the Code of Civil Procedure the learned trial Court shall make an endeavour to dispose of the Misc. Case No. 12 of 2024 as expeditiously as possible.
There shall be, however, no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
