The petitioner has filed the present application being CAN 1 of 2025 praying for recalling of the order dated July 2, 2025 by which the writ petition being WPA 21647 of 2024 is dismissed for default.

2. The learned counsel for the petitioner submits that the matter was listed as Serial no. 680 in the Monthly List of June, 2025 but all of a sudden the matter was taken up on July 2, 2025. On the said date due to ill health the learned advocate for the petitioner could not appear before this Court, the matter is dismissed for default.

3. Heard the learned counsel for the parties.

4. This Court finds that sufficient cause has been shown for none appearance of the petitioner on the date of hearing, the order dated July 2, 2025 is recalled.

5. WPA 21647 of 2024 is restored to its original file.

6. CAN 1 of 2025 is disposed of.

7. Let WPA 21647 of 2024 be placed under the heading "Adjourned Motion" on December 4, 2025.

8. Learned counsel for the petitioner is directed to serve copy of the writ application along with all annexures to the learned counsel for the Durgapur Municipal Corporation by tomorrow.
