The husband of the petitioner is a victim of tiger attack. The post mortem report of the husband of the petitioner is annexed to the writ petition. 2.
Prayer has been made for grant of ex gratia to the victim of depredation caused by wild animals in terms of the order of the Forest Department published vide Memo No. 1/123199/2021 dated 26th February, 2021.

The respondents raise serious objection with regard to the relief sought for by the petitioner. 4.
It appears that similar issue has been decided by the Court on 9th April, 2025 in the case of (Binarani Mandal _vs- The State of West Bengal & Ors.) wherein after considering all submissions made by the parties, the Court directed the Conservator of Forests and Field Director to pay compensation to the heirs of the deceased in accordance with the Order
passed by the Deputy Secretary, Government of West Bengal, Department of Forests.

As the facts of the instant case are similar to the facts of Binarani Mandal (supra), accordingly, similar direction is being passed.

The respondent no. 2 is directed to pay compensation to the heirs of the deceased Hairpada Mondal in accordance with the Order passed by the Deputy Secretary, Government of West Bengal, Department of Forests at the earliest but positively within a period of eight weeks from the date of communication of this order.

Instruction forwarded by the Chief Conservator of Forests dated 13th March, 2025 be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
