Ms. Aiswarjya Gupta ..For the Petitioner Mr. Jayanta Samanta Mr. Debjyoti Chakraborty ....For the State The petitioner has prayed for participation in the recruitment process pursuant to recruitment notice issued by the West Bengal Police Recruitment Board.

Ms. Gupta, learned counsel appears on behalf of the petitioner.

Mr. Samanta, learned counsel appears on behalf of the State respondents.

Considering the submissions of the parties and the materials placed on record, this Court is of the view that the petitioner has challenged the recruitment process for being appointed as a State Government employee. As such the appropriate Tribunal is the Court at first instance. A beneficial reference may be made to the Apex Court's judgement in L. Chandra Kumar vs. Union of India & Ors. reported in (1997) 3 SCC 261.

In such view of the matter, this Court does not have the jurisdiction to receive, try and entertain the present writ petition.

Accordingly, W.P.A. 21020 of 2023 is dismissed, with liberty to file afresh, before the appropriate Forum, on the selfsame cause of action.

It is made clear that this Court has not gone into the merits of the writ petition.
