Learned counsel for the State-respondents submits that an order under Section 10(3) of the West Bengal Highways Act, 1964 has been passed by the SubDivisional Officer, Kharagpur on 05.07.2021 and the petitioners should take recourse to the appropriate provisions of law.

Learned counsel for the petitioners submits that he has instructions to withdraw the writ petition and approach the appropriate forum for redressal of their grievance.

In view of the above, the writ petition being WPA No. 21422 of 2022 is dismissed for non-prosecution. Liberty is granted to the petitioners to approach the appropriate forum for redressal of their grievance. There shall be, however, no order as to costs.
