Learned advocate appearing for the petitioner is aggrieved by the fact that in Misc. Execution Case No. 503 of 2018 earlier this Hon'ble Court in CRR 711 of 2021 passed a direction on 20.06.2022. Learned advocate submits that at that stage the dues were Rs.42,000/- and a sum of Rs.27,000/- till date has been paid towards the said amount. Subsequently the amount has accumulated and presently there are arrears of Rs.1,80,000/-. It has been informed that the next date is fixed on 14.09.2023.

The learned Judicial Magistrate, 4th Court, Alipore is directed to see that by three instalments and by December 2023 the whole of the dues are cleared. To that effect, if required, the learned Magistrate will fix one day in a week for the purpose of the present case and a specific direction be given so that on each week, some payments are made which would lead to diluting of the amount so contended or the arrears so accumulated till date.

With the aforesaid observations, the revisional application being CRR 3284 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
