Present petition has been filed for transfer of Matrimonial Suit No.2795 of 2022 from the court of learned Additional District Judge, Fast Track Court No.3 at Barrackpore, North 24 Parganas to the learned District Judge, Sadar Hooghly, Chinsurah. 2.

Learned counsel for the petitioner submits that between the parties, three other cases out of matrimonial disputes are pending in court at Chinsurah in which the opposite party has been regularly appeared.

Leaned counsel, therefore, submits that the matter may also be transferred to the competent court of Chinshurah.

Learned counsel for the opposite party has opposed the plea of transfer on the ground that as per the petitioner herself, there is a distance of only around 40 k.m. between the place of residence of the

petitioner and the court at Barrackpore. Learned counsel submits that therefore the plea for transfer may be rejected.

The court has considered the submissions, it is an admitted fact that three other cases out of matrimonial dispute are pending before the competent court at Chinsurah in which the opposite party is duly appearing. The court considers that it would be convenient for both the parties if all the matters are tried at the same court.

In the circumstances, the Matrimonial Suit No.2795 of 2022 is withdrawn from the learned Additional District Judge, Fast Track Court No.3 at Barrackpore, North 24 Parganas and is assigned to the competent court of jurisdiction under learned District Judge, Sadar Hooghly, Chinsurah for trial in accordance with the law.

Accordingly, the petition stands disposed of. 7.
