Upon urgency being pleaded and since the regular determination has been assigned to this Court, this writ petition has been taken up for consideration by this Court. Affidavit of service filed in Court today, is taken on record, which shows that the concerned Municipality has duly been served with the notice of the writ petition. The mentioning notices dated February 10, 2025 have also been filed before this Court showing notices were served upon the respondents.

The petitioner is the widow of Krishna Chandra Santra since deceased, who was an employee of the respondent no.4.

The deceased employee died on September 25, 2019. The widow started receiving family pension on and from May 1, 2023 and has been

continuing to receive the same. The widow claims the arrear family pension which has not been released on and from the next date of the death of the deceased husband, i.e. September 26, 2019. The petitioner has made representation dated May 9, 2024, annexure p-3 at page18 to the writ petition but the same has not yet been considered. Referring to a subsequent document dated May 31, 2024 at page-25 to the writ petition, petitioner submits that the Chairman of the Municipality has calculated and has admitted the quantum payable to the petitioner on account of her family pension since her husband died.

The petitioner accepts the statement of calculation appearing at the said document dated May 31, 2024 at page-25 to the writ petition.

In view of the above, the respondent nos. 6 and 7 are directed to release the entire amount in favour of the petitioner in terms of the statement of calculation dated May 31, 2024 at page-25 to the writ petition but the payment shall reckon from the next date of the death of the deceased employee, i.e. September 26, 2019. While making the payment for the period between September 26, 2019 till April 30, 2023, the respondent nos. 6 and 7 shall calculate the same along with interest at the rate of 6 per cent per annum to be paid to the

petitioner till the date of actual tendering of the amount to the petitioner.

The petitioner shall serve a copy of this order upon the respondent no.5 also who shall oversee the affair of the respondent nos. 6 and 7 so that the direction of this Court stands complied with.

In compliance of the direction made herein, the entire payment shall be made to the petitioner by crediting her bank account positively within a period of six weeks from the date of communication of this order. It is made clear that this direction is mandatory and peremptory.

With the above observations and directions, this writ petition, WPA 21662 of 2024 stands disposed of, without any order as to costs.
