It is submitted on behalf of the petitioner that the petitioner had applied for retirement benefits of a deceased employee in accordance with law. However, despite receipt of such representation the concerned authority being the Block Development Officer, i.e., the respondent no. 8 has taken no steps to dispose of the same.

On behalf of the State respondents, it is submitted that the above representation is a fake representation and the petitioner is not entitled to any disbursement.

On behalf of the private respondents, it is submitted that the petitioner is the divorced wife and is not entitled to any dues of the deceased employee and the

entire claim of the petitioner is untenable in law. In view of the submissions made on behalf of the parties, WPA 21664 of 2024 stands disposed of by directing the respondent no. 8 to consider the representation dated 7th May, 2024 within a period of six weeks from the date of communication of this order to the said respondent and after giving a right of hearing to the concerned parties including the respondent no. 10, in accordance with law and without being influenced by any observation made in this order.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the respondent no. 8 in accordance with law.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
