Petitioner submits victim died due to an accident. He has been falsely implicated. Co-accused has been enlarged on bail. Accordingly, he prays for bail.

Learned Advocate for the State opposes the bail prayer. 3.

We have considered the materials on record. Victim appears to have suffered injuries in an accident and died on 28.12.2023.

Under such circumstances, co-accused viz., Gopal Sarkar has been enlarged on bail. Petitioner is entitled to similar relief.

Accordingly, the petitioner viz., Bijoy Roy shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24-Paraganas subject to condition that he shall Signed By : ALOK SETH High Court of Calcutta 12 th of November 2024 05:02:16 PM

appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to appear before the Trial Court without any justifiable cause, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
