The order dated 07.10.2024 reflects that none appeared on behalf of the petitioners or for the State, as such, the writ petition was adjourned. Records reflect that the writ petition was preferred for implementing the order of injunction passed by the civil court. To that effect, information was furnished on or about 14.06.2024 to the Officerin-Charge, Jamalpur Police Station. The information reflects relating to the civil suit pending before the learned Civil Judge (Junior Division), 2nd Court, Burdwan in T.S. No.347 of 2023. There are accusations of trespass, physical assault, criminal intimidation, wrongful restraint, unlawful assembly for which police protection and appropriate police action was sought for.

As none appears on behalf of State, Ms.

Mohuya Dutta Biswas, learned advocate, who ordinarily appears on behalf of the State, is directed

to represent the State. Her appearance may be regularized by the concerned authorities.

Having considered the information which was furnished before the Officer-in-Charge, Jamalpur Police Station and the time period which has lapsed since then, I direct that the petitioners would approach the jurisdictional Magistrate under the relevant provisions of law for necessary remedies. Learned Magistrate will assess and ascertain regarding the nature of the accusation and pass necessary directions as he deems fit and proper. With the aforesaid observations, WPA 21661 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
