This is a second contempt application in respect of the order dated 08.08.2022. The first contempt application being CPAN 1253 of 2022 was disposed of directing the School Service Commission to recommend an appropriate school. 2.

Such recommendation has already been made by the Commission to Kakinara Urdu Girls High School. The petitioner is not comfortable with such recommendation although it was made in a joint sitting with the Chairman of the School Service Commission.

The second contempt application has been filed giving a choice of further school alleging non compliance of the order dated 08.08.2022.

This Court sees that the respondents have already complied with the said order dated 08.08.2022 as recorded in the order dated 03.0.2023 in CPAN 1253 of 2022.

This Court is of the view that the second contempt application being CPAN 1165 of 2023 is in gross abuse of process of law.

Hence, CPAN 1165 of 2023 is dismissed with costs assessed at Rs.5,100/- payable by the petitioner to the School Service Commission.

It is also made clear that if the petitioner does not join Kakinara Urdu Girls High School within a period of days, her appointment and recommendation to the said school shall stand automatically cancelled.
