Sadhu .... For the State Liberty is granted to the petitioner to implead the Special Land Acquisition Officer, Purba Bardhaman as respondent No. 4 in the writ petition. The writ petition be amended accordingly. Copy of the affidavit-inopposition filed by the State respondents is taken on record. Let the same be treated as original.
It is submitted on behalf of the petitioner that he is a co-sharer of the plot in question which was taken by the Public Works Department for construction of temporary Suri road. No notice of acquisition was served upon the petitioner and the petitioner was also not paid any compensation for the same. The petitioner claims compensation in respect of the said land from the State Authority.
It is submitted on behalf of the State respondents that the petitioner may submit a comprehensive representation stating all the facts along with relevant documents before the concerned Authority who shall dispose of the same within a stipulated period of time. Having considered the submissions made on behalf of the parties, the writ petition is disposed of with liberty to the petitioner to submit a representation with all relevant documents before the 4th respondent ventilating his grievance within a week from date. Upon receipt of such representation, the 4th respondent shall consider and dispose of the same within one month thereafter after giving reasonable opportunity of hearing to the interested parties including the petitioner, in accordance with law.
W.P.A. 20111 of 2015 is thus disposed of.
There shall be no order as to costs.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
