It is contended on behalf of the petitioners that the petitioners applied for long term mining lease before the State respondents for extraction of black stone on 2nd April, 2015 after complying with all formalities and depositing the requisite fees for the purpose. But the mining lease has not been executed in favour of the petitioners till date. Learned counsel for the petitioners submits that the application submitted by the petitioners was forwarded to the Director, Directorate of Mining and Minerals, West Bengal by the office of the Chief Mining Officer, Government of West Bengal by a memo dated 17th November, 2015, but no further steps have been taken. The petitioners seek liberty to submit a comprehensive representation before the concerned authority in this regard and pray for a direction upon the authority to consider the same at the earliest.
It is submitted on behalf of the respondents that the 6th respondent be directed to consider the representation in accordance with law.
In view of the above, the writ petition being WPA 21441 of 2022 is disposed of with liberty to the petitioners to submit a comprehensive representation before the 6th respondent within two weeks from date. The 6th respondent is directed to consider and dispose of the representation within two months from the date of receipt thereof upon affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law.
The decision taken by the authority shall be communicated to the petitioners within a week thereof. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
