It is submitted on behalf of the petitioner that he has been falsely implicated but he admitted that he is the owner of the truck. Further submission of the petitioner is that he has been in custody for a considerable period and the trial has not progressed and accordingly prays for bail. 2.

Learned counsel for the State raises strong objection. He submits that before the Trial Court the date has been fixed immediately after the Vacation for framing of charge. 3.

After hearing both the learned advocates for the parties and considering the huge quantity involved in this matter and

taking note of Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. 5.

However, in view of the fact that the charge has not yet been framed and considering that the petitioner is in custody for considerable period of time, the learned Trial Court is directed to expedite the hearing at the earliest. 6.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
