The learned Counsel for the petitioners/appellants has produced a letter issued by one of the partners of the partnership firm in the letter head of the partnership firm, Jewellery Museum, dated 9th November, 2024 and has submitted that the appellants are not willing to proceed with the appeal.

It appears from the letter of instruction that a request was made to the learned Counsel to withdraw the case.

In view of such clear instruction, the appeal and the application stand dismissed without any liberty to file afresh on the self-same cause of action. The impugned order, if any, shall stand vacated.

The original letter of instruction dated 9th November, 2024 is kept with the record.

The original certified copy of the order impugned may be returned to the learned Advocate for the appellants after retaining a Photostat copy of the same.
